A three-judge bench, headed by Justice N V Ramana, issued  notices to the Centre and Maharashtra government on a petition filed by  the Shiv Sena-NCP-combine against the Maharashtra Governor’s  decision to allow BJP to form government in the state.
The Top Court said the plea seeking a direction for immediate floor test has to be considered tomorrow after the hearing concludes.
contended before Supreme Court that the BJP must face a floor test if it has majority in the house, and only then, it should be allowed to form a government.
It accused State Governor Bhagat Singh Koshyari of bias and said that the lifting of President’s Rule was “shrouded in mystery.”
Meanwhile, BJP, which secured 105 seats out of 288-member Maharashtra Assembly seats, told the Apex Court that the petition is filed by three political parties and not an individual. A BJP MLA cited it as the violation of Article 32. (UNI)
